Terms of Use

Version 1.2, published on October 31, 2026

1. PURPOSE

KILTIZANA (kiltizana.com and its apps) is an international marketplace for art and craft. It connects artisans, artists, galleries and cooperatives (the "Workshops") with buyers around the world, with a first focus on Haitian creation. These terms apply to anyone who visits the site, creates an account, buys or sells.

By creating an account or placing an order, you accept these terms in their current version. Each acceptance is recorded (version, date, device).

2. DEFINITIONS

• Platform: the kiltizana.com website, its API and its apps.
• Buyer: anyone who orders a work, with or without an account.
• Workshop: the seller (artisan, artist, gallery or cooperative) whose application has been accepted.
• Work: any item published by a Workshop: one-of-a-kind piece, series, limited edition, made-to-order creation or digital file.
• Commission: KILTIZANA's fee, deducted from each sale.

3. PUBLISHER

The site is published by JOBOSOFTWARE, trade name of John Boisguene (sole proprietorship), registered in the commercial register of the Ministry of Commerce and Industry under no. 165 Reg. 279, business licence (patente) no. 5607158234, with its registered office at 135, avenue Jean-Paul II, Turgeau, Port-au-Prince, Haiti. Contact: direction@kiltizana.com. Full legal notices are on the Legal notice page (https://kiltizana.com/pages/mentions-legales).

4. ACCOUNT

• You must be 18 or the age of majority in your country to create an account and sell. A minor may only buy with a parent's consent.
• Your information must be accurate. Your email address is confirmed with a code before any sensitive action (ordering, opening a workshop, requesting a payout).
• You are responsible for your password. Turn on two-factor authentication; it is mandatory for team accounts.
• An account is personal. You can close it at any time from your account, unless an order is in progress or a payout is pending. Data the law requires us to keep (invoices, disputes) is kept, and your identity is anonymised.
• You can buy without an account. Tracking is then done through a link sent by email.

5. KILTIZANA'S ROLE

KILTIZANA is an intermediary. The sales contract is made directly between the Buyer and the Workshop. KILTIZANA provides the storefront, the cart, payment collection (when open), messaging, tracking, dispute mediation and the payout of amounts owed to Workshops. KILTIZANA does not make the works and does not own them.

6. BECOMING A WORKSHOP

• Every seller submits an application (background, skills, materials, photos of their works). The team may ask for more information, accept or decline, with a reason.
• The applicant declares that the works shown are their own or those of the workshop they represent.
• An identity check (valid ID, proof of address) may be required before the first payout.
• The Workshop provides accurate payout details (MonCash, NatCash or bank account). They are encrypted.

7. PUBLISHING WORKS

The Workshop guarantees that each listing is accurate: title, real photos of the work, materials, dimensions, condition, production time and shipping costs. In particular:

• only state "handmade", "one of a kind", an age, a signature, a provenance or a certificate if it is true and can be proven;
• a limited edition never exceeds the announced print run;
• texts suggested by the writing assistant are only published after the Workshop has reviewed and approved them, and the Workshop remains responsible for them;
• any change to a published work may go back to moderation review.

8. WHAT IS NOT ALLOWED

• Selling items you did not create or have no right to sell, counterfeits or copies of protected works.
• Selling protected cultural property, archaeological objects, protected species (ivory, tortoiseshell, coral…) or any product banned by the law of the country of origin or destination.
• Offering to pay outside the platform, or getting around the commission. Contact details are hidden in messaging until there is a paid order and both parties agree.
• Posting fake reviews, rating your own work, manipulating prices or rankings.
• Sending hateful, violent or illegal content, harassment or unwanted messages.
• Sending a bank card number by message (it is blocked automatically).

9. PRICES AND ORDERS

• Prices are freely set by the Workshop, in its currency. A price converted into another currency is for information only; the currency charged is shown before payment.
• Before paying, the Buyer sees a complete summary: each work, price, quantity, shipping cost of each Workshop, estimated delivery time, total and amount due now. If a price, stock level or shipping cost changes in the meantime, the order is refused and a new summary is shown.
• Customs duties and import taxes of the destination country are not included, unless stated otherwise, and are paid by the Buyer.

10. KILTIZANA'S COMMISSION

Signing up, opening a workshop and publishing works are free. KILTIZANA is paid only when a sale goes through:

• Commission on each sale: 15% of the price of the works sold (after any discount funded by the Workshop).
• Shipping: no commission; the Workshop keeps 100% of the shipping charged.
• Fee to publish a work: none.
• Monthly subscription: none.
• Payment fees (MonCash, NatCash, card): none; they are included in the 15% commission.

Example: a work sold for 10,000 HTG, with 1,500 HTG shipping. Commission: 1,500 HTG (15% of 10,000). The Workshop receives 8,500 HTG + 1,500 HTG shipping = 10,000 HTG.

• A different rate may apply to certain categories, listing types or countries. It is always shown in the Workshop's account before the work is put on sale.
• The rate is locked at the time each order is paid. A rate change never applies to sales already paid.
• Any change to the fee schedule is announced to Workshops at least 30 days in advance.
• In case of a refund, the commission is refunded in proportion to the amount refunded.

11. PAYMENT

• Payment is made only on the platform. The available methods are shown at checkout.
• As long as online payments are not open, the site says so and no payment is requested.
• Made-to-order creations are paid in two steps: a deposit set in the accepted quote, then the balance once the Buyer has approved every stage. Nothing is shipped before full payment.
• KILTIZANA gift cards are valid only on the platform and cannot be exchanged for cash.

12. PAYOUTS TO WORKSHOPS

• The Workshop's share (price − commission + shipping) is added to its balance once the order is fully paid. Nothing is credited on a deposit alone.
• It is held for 14 days after payment is received (claim period), then becomes available.
• The Workshop requests a payout from its account, above a displayed minimum amount. It is approved by the finance team (two approvers above a threshold), then paid by MonCash, NatCash or bank transfer.
• Payout method fees are paid by KILTIZANA: the Workshop receives the amount requested, with no deduction.
• KILTIZANA may hold a payout in case of an open dispute, suspected fraud or a legal request. The balance is never lost.
• The Workshop is responsible for its own taxes and tax returns on its sales.

13. DELIVERY

• Each Workshop ships its own works, within the time stated on the listing, with packaging suited to fragile pieces.
• It enters the carrier and tracking number; the Buyer tracks the parcel from their account or from the link received by email.
• In case of a significant delay, the Buyer may open a claim (section 15).

14. RETURNS AND REFUNDS

• Change of mind: request possible within 14 days of delivery, if the Workshop accepts returns for that work. Return shipping is then paid by the Buyer, unless agreed otherwise.
• Damaged, not as described, wrong or incomplete work: claim possible within 30 days of delivery, with photos.
• Custom-made and personalised creations, and digital files already downloaded, are not taken back for a change of mind, unless defective.
• The Workshop responds to the request; a refusal must give a reason. The refund is made to the payment method used, after the work is received if a return is requested.
• Where the law of the Buyer's country provides a longer period, that period applies.

15. DISPUTES AND MEDIATION

• Buyer and Workshop may open a dispute within 90 days of payment.
• The Workshop has 72 hours to respond. KILTIZANA's mediation team, which takes neither side, then reviews the evidence and gives a reasoned decision within 10 days: full refund, partial refund or no refund.
• Each party may appeal once, within 7 days. The appeal is reviewed by a different person from the one who made the decision.
• This mediation does not prevent anyone from going to the competent courts.

16. MADE-TO-ORDER CREATIONS

The Buyer requests a quote; the Workshop proposes a price, a lead time, a deposit and stages. Once the quote is accepted and the deposit paid, the stage plan is locked. The Workshop presents each stage; the Buyer approves it or asks for a reasoned revision. The balance is due after the last approval.

17. REVIEWS

• Only a Buyer whose order has been delivered (or paid, for a digital file) may leave a review, within the following year. One review per person per work.
• The Workshop may reply publicly. It may not rate its own works or have a sincere negative review removed.
• A review can be reported; moderation publishes or removes it, with a recorded decision.

18. INTELLECTUAL PROPERTY

• The Workshop remains the owner of its works, photos and texts. For as long as the work is on sale, it grants KILTIZANA a free, worldwide licence to display them, adapt them to the site's format and use them to promote the platform (social media, newsletter), crediting the Workshop.
• Buying a physical work does not transfer the copyright. A digital file is sold with the licence stated on its listing.
• The KILTIZANA name, logo and brand may not be used without written permission.
• Anyone who believes a work infringes their rights (copyright, trademark, traditional know-how) can report it on the Intellectual property page (https://kiltizana.com/propriete-intellectuelle). The work may be removed temporarily; the Workshop may reply with a signed counter-notice within 10 days.

19. MODERATION AND SANCTIONS

If these terms are breached, KILTIZANA may, depending on severity: refuse or remove a work, hide a review or a message, suspend an account or a workshop (with a reason and, where relevant, an end date), or hold payouts. Each decision is reasoned and recorded. The person concerned may contest a moderation decision; the challenge is reviewed by a different person.

20. LIABILITY

• The Workshop is solely responsible for its works, their compliance, their description, their shipping and compliance with export laws.
• KILTIZANA does its best to keep the site available and secure, without guaranteeing permanent availability. It is not liable for delays or losses caused by carriers, customs or payment providers, without prejudice to the mediation provided in section 15.
• Automated help features (writing assistant, translation, image search, price estimate) give suggestions. They do not replace checking by the Workshop or the Buyer.
• Nothing in these terms limits the rights the law gives to consumers.

21. CHANGES TO THESE TERMS

KILTIZANA may change these terms. Each new version is dated, comes with a summary of changes, and must be accepted before the next sensitive action. Orders already paid remain governed by the version in force at the time of payment.

22. GOVERNING LAW

These terms are governed by Haitian law. Failing an amicable settlement, disputes fall under the jurisdiction of the courts of Port-au-Prince, subject to the mandatory rules that protect consumers in their country of residence.
